Remote I-9 Document Verification Ends

As a result of COVID-19, the Department of Homeland Security (DHS) provided flexibility in the requirement to perform in-person physical inspection of identity and employment authorization forms as they relate to the I-9. These flexibilities were initially announced March 2020 and updated in March 2021.

On May 5, 2023, the U.S. Immigration and Customs Enforcement (ICE) announced these flexibilities will end on July 31, 2023. For those employers that performed remote I-9 document verification during this period, you must complete the physical document inspections for those employees whose documents were inspected remotely by August 30, 2023.

In 2022, DHS published a Notice of Proposed Rulemaking to permanently allow the remote verification of I-9 documents. It is anticipated the Final Rule will be published in the Federal Register to implement that proposal.
