Understanding the Ohio Pay Stub Protection Act
Last Updated on April 1, 2025
The Ohio Pay Stub Protection Act (Ohio House Bill 106) is a significant legislation designed to ensure transparency and accountability in employee compensation. Slated to go into effect on April 9, 2025, this law mandates that employers provide employees with detailed information about their earnings and deductions, fostering a workplace culture of trust and clarity.
Key Requirements of the Ohio Pay Stub Protection Act
Under the Ohio Pay Stub Protection Act, employers are required to provide employees with a statement or access to a statement of their earnings and deductions on regular paydays. If an employer fails to provide this information, the employee can formally request the statement. The employer then has ten days to comply with the request.
If the employer does not fulfill the request within the ten-day timeframe, the employee can report the violation to the Director of Commerce. Upon receiving a complaint, the Director must notify the employer of the violation in writing. Additionally, the employer must display this notice from the Director of Commerce or a copy of it in a prominent location on the premises for ten days.
Importance for Employers
Compliance with the Ohio Pay Stub Protection Act is essential for employers to maintain a positive and transparent work environment. Providing pay stubs helps employees understand their compensation, including deductions for taxes, benefits and other withholdings. Transparency in payroll practices not only boosts employee confidence but also reduces the likelihood of disputes.
